The U.S. Federal Communications Commission (FCC) is also reported to be drafting regulations intended to address the rights of social media companies under FCC rules.
According to a posting this month on the website of CNN, FCC Chair Ajit Pai has indicated that he will move forward with efforts to clarify Section 230 of the Communications Act of 1934, which addresses protections for the private blocking and screening of offensive material. Pai has reportedly indicated in a recent tweet that the FCC’s general counsel has advised him that the FCC has the legal authority to interpret Section 230 under the scope of its jurisdiction.
Action by the FCC in connection with Section 230 has been spurred in part by a Presidential Executive Order signed in May of this year calling on the FCC to develop rules to interpret Section 230. But it has also been a flashpoint for those who believe that social medial platforms are biased and controlling content presented by their users.
