Commission Denies Petition for TCPA Exemption for “Robo-Texting”

The U.S. Federal Communications Commission (FCC) has reaffirmed its restriction against robo-texting, or the sending of unwanted text messages to wireless telephone numbers.

In an Order issued on January 11, 2016, the Commission denied a 2009 petition from Club Texting, Inc., a text messaging platform provider, to consider unwanted text messages under the same provisions as those applicable to fax broadcasters. In its decision, the Commission reaffirmed the separate liability standard for text message apps and platforms it established in June 2015, which provides wireless consumers with the same consent protections for texts as those for voice calls.
